As was clear at the time and has become even more clear in subsequent years, Bhutto's trial, conviction and sentence was a gross failure of justice.
Yesterday, nine judges of the Supreme Court presented their opinion to the president. First, a short story.
Bhutto's Path to the Gallows When he came to power, Bhutto made several promises: roti, kapra, aur makaan (food, clothing and shelter), a classless society, nationalization of central industries, ending the influence and power of land feudal lords. The PPP's first election manifesto ended with the following words: all power to the people. Its supporters invoke the Simla Agreement; his party's role in the 1973 Constitution; the ability to gain the support of people from all walks of life; and the pursuit of an independent foreign policy as examples of his successes.
His critics point to his involvement in preventing Sheikh Mujibur Rahman from legally forming a government after the 1970 elections, the creation of the Federal Security Service (FSF), and the rigging - by most accounts - of the 1977 elections that set the stage for Zia's regime. The FSF was Bhutto's own paramilitary force, armed with over fifteen thousand officers. As Rafi Raza writes, the FSF was ineffective when it came to anything other than "terrorizing political opponents." Even Bhutto's men became targets of the FSF's wrath.

When JA Rahim reached home that night, FSF goons barged into his bedroom, beat him and hit him with rifle butts.
Masood Mahmood, head of the FSF, once responsible for terrorizing Bhutto's opponents and loyalists (on the orders of Bhutto himself) became a key witness against him during the trial.
Marshal Zia's Law The Bhutto trial cannot be viewed without context: Zia's regime was brutal and suspended basic rights. Dozens of political prisoners, including PPP leaders, were detained and arrested. Martial law laws gave martial law administrators unlimited power to detain individuals to prevent them from acting in a manner detrimental to the purposes for which martial law was imposed. Political activity was banned. Political speech was not allowed. Some martial law laws included flogging as a punishment.
A 1978 Amnesty International report stated that political prisoners were sentenced to flogging for "raising slogans against the government". According to Amnesty, some people who chanted slogans in favor of Bhutto were subjected to floggings as punishment by Zia's regime. It cannot be denied that Zia had a special, separate interest in the Bhutto case.
A farcical trial On September 3, 1977, Bhutto was arrested on charges related to the murder of Nawab Muhammad Ahmed Khan Kasuri.
